1. Agreement & Supported Platform

These Terms of Service and Software License Agreement govern your download and use of Exevery and its associated runtime packages offered by RacoLab. Exevery is designed exclusively for Apple Silicon Mac computers (arm64) running macOS 14.0 or later and requires downloading a shared ~3GB virtual machine and translation runtime image (10 GB free disk space recommended).

2. Product Tiers: Free Game Mode & Licensed Compatibility Mode (Decisions 1A & 2A)

3. Paid Perpetual License, 2-Device Limit & Self-Service Deactivation (Decision 4A)

Subject to payment of the applicable one-time license fee (draft placeholder: $29 launch / $49 regular, pending final owner confirmation prior to live checkout) via Paddle Billing, RacoLab grants you a non-exclusive, non-transferable, perpetual license to run eligible versions of Exevery Compatibility Mode:

4. 1-Year Update Window (updates_until) & Perpetual Execution (Decision 5A)

5. Third-Party Windows Software & Compatibility Disclaimer

Exevery does not include Microsoft Windows or any third-party Windows applications or games. You are solely responsible for obtaining valid licenses for any third-party software you install or run. Compatibility varies by application and version; RacoLab publishes tested results on the Compatibility Matrix and does not warrant or guarantee that all Windows executables or copy-protection schemes will run error-free.

6. Preservation of User Data (preserve_installed_data: true)

When a Compatibility Mode trial expires, an updates_until window lapses, a device is deactivated, or a license is refunded or revoked, Exevery does not delete your locally installed Windows programs, bottles, or user data on your Mac (preserve_installed_data: true), allowing you to access, back up, or migrate your files.

7. Open-Source Components & Notices

Exevery and the runtime image incorporate open-source software components (including Linux kernel components, FEX-Emu, Wine, and graphics translation libraries) licensed under their respective open-source terms (such as GPL, LGPL, MIT, and BSD). Nothing in these Terms restricts your rights under applicable open-source licenses; corresponding open-source notices and source code offers are provided with the software distribution or upon request to support@exevery.app.

8. Limitation of Liability & Consumer Rights

To the maximum extent permitted by applicable law, Exevery is provided "as is" without warranties of merchantability or fitness for a particular purpose, and RacoLab's aggregate liability shall not exceed the amount paid by you for the software license. Nothing in these Terms excludes or limits mandatory statutory consumer rights in your jurisdiction.
